Tijuana Cancer Clinic by Dr. Salvador Vargas (hereinafter referred to as "the Clinic", "we", or "us"), located in Tijuana, Baja California, Mexico, is committed to protecting your personal data in accordance with the Federal Law on Protection of Personal Data Held by Private Parties (Ley Federal de Protección de Datos Personales en Posesión de los Particulares) and its Regulations.

1. Data We Collect

We collect personal and sensitive information necessary to provide specialized oncology and medical care. This includes:

  • Identification Data: Full name, age, date of birth, gender, address, phone number, email, and copy of identification (INE, Passport).

  • Medical & Health Data (Sensitive): Clinical history, current diagnosis, previous cancer treatments (chemotherapy, radiation), allergies, genetic information, lab results, and imaging studies.

  • Financial Data: Billing information, insurance policy details, and payment method information for invoicing purposes.

2. Purpose of Data Use

Your personal data will be used for the following primary purposes:

  • Provision of medical consultations, cancer screening, and treatment planning.

  • Creation and maintenance of your Clinical Record (Expediente Clínico) as required by Mexican Official Standard NOM-004-SSA3-2012.

  • Communication regarding appointments, test results, and follow-up care.

  • Billing and collection for services rendered.

3. Data Transfer

We do not sell your data. However, your data may be transferred to third parties strictly for medical or legal reasons, including:

  • Laboratories and Imaging Centers: To process tests and studies required for your diagnosis.

  • Insurance Companies: To process coverage claims if applicable.

  • Medical Specialists: If a referral or multi-disciplinary opinion is required for your treatment.

4. ARCO Rights

You have the right to Access, Rectify, Cancel, or Oppose (known as ARCO Rights) the handling of your personal data.

  • Rectification: You may request corrections to outdated or incorrect data.

  • Cancellation: You may request that we delete your data if it is not being used in accordance with the law (subject to data retention laws for medical records).

TERMS AND CONDITIONS OF SERVICE

By scheduling an appointment or receiving services at Tijuana Cancer Clinic by Dr. Salvador Vargas, you (the "Patient") agree to the following Terms and Conditions.

1. Medical Services

The Clinic provides specialized oncology consultations, diagnostic evaluations, and treatment plans.

  • No Guarantee of Cure: Medicine is an inexact science. While Dr. Salvador Vargas and his team utilize evidence-based and advanced treatments, no specific results or cures are guaranteed. Results vary based on individual pathology and patient response.

  • Informed Consent: Specific procedures (biopsies, chemotherapy, etc.) will require a separate Informed Consent form detailing specific risks.

2. Appointments and Cancellations

  • Scheduling: Appointments must be booked in advance via phone or our official communication channels.

  • Cancellations: We require at least 24 hours' notice for cancellations or rescheduling.

  • No-Shows: Failure to attend a scheduled appointment without notice may result in a cancellation fee of [Insert Amount, e.g., $50 USD] or forfeiture of any deposit paid.

  • Late Arrivals: If you arrive more than 15 minutes late, we may need to reschedule your appointment to avoid delaying other patients.

3. Payment Policy

  • Payment Due: Full payment for consultations and treatments is due at the time of service unless a prior agreement is made.

  • Methods: We accept cash (MXN/USD) and major credit/debit cards.

  • Insurance: We may provide documentation for you to submit to your insurance for reimbursement, but we do not guarantee coverage. The Patient is ultimately responsible for all costs incurred.

  • Cross-Border Patients: For patients visiting from the USA or other countries, prices may be quoted in USD for convenience, but official receipts (Facturas) will be issued in compliance with Mexican fiscal laws.

4. Patient Responsibilities

  • Accurate Information: You agree to provide complete and accurate information regarding your medical history, current medications, and allergies. The Clinic is not liable for adverse events caused by withheld information.

  • Conduct: We maintain a respectful environment. Harassment or abusive behavior toward staff or other patients will result in immediate termination of services.

5. Limitation of Liability

  • Jurisdiction: Any legal dispute arising from services provided by the Clinic shall be resolved exclusively within the courts of Tijuana, Baja California, Mexico, waiving any jurisdiction that might correspond to the Patient by reason of their present or future domicile.

  • Medical Tourism: If you are traveling to Tijuana for care, you acknowledge that you are seeking care in Mexico and agree to be bound by the laws and medical standards of Mexico.

6. Emergency Situations

The Clinic is an outpatient facility. In the event of a life-threatening medical emergency outside of clinic hours, please dial 911 or proceed to the nearest hospital emergency room immediately.
